Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Stamped ("Company", "we", "us", or "our") governing your use of the Stamped mobile application and website (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you affirm that you are at least 13 years old and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes via push notification or email. Continued use of the Service after the effective date of changes constitutes acceptance.

2. Account Registration

To use Stamped, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Be responsible for all activity that occurs under your account
• Notify us immediately at hello@stamped.app if you suspect unauthorized access
• Not create more than one account or create an account on behalf of another person without their consent

You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement.

3. User Content and Intellectual Property

3.1 Your Content

You retain full ownership of all content you create, upload, or share on Stamped ("User Content"), including stamps, trip itineraries, photos, ratings, and notes.

3.2 License to Stamped

By submitting User Content to Stamped, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and prepare derivative works of your User Content solely for the purpose of operating and improving the Service and as permitted by our Privacy Policy.

This license ends when you delete your content or your account, subject to our standard retention period of 30 days for backup and legal purposes.

3.3 Our Intellectual Property

The Service, including its design, software, trademarks, and content created by Stamped, is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

4. User Conduct

You agree to use Stamped in a lawful, respectful manner. You must not:

4.1 Prohibited Content

• Post false, misleading, or fabricated ratings or reviews — all stamps must reflect genuine personal experiences
• Create fake accounts or impersonate any person or entity
• Post content that is illegal, defamatory, obscene, pornographic, or harassing
• Post content that infringes the intellectual property rights of others
• Share private information about others without their consent ("doxxing")
• Post violent, threatening, or hateful content targeting individuals or groups
• Post spam, unsolicited advertisements, or promotional material without authorization
• Coordinate or engage in review manipulation, whether positive or negative

4.2 Prohibited Conduct

• Harass, bully, intimidate, or threaten other users
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated bots, scrapers, or other tools to access or extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent any security or access controls
• Use the Service for any commercial purpose without our written consent
• Resell, sublicense, or transfer your account or the Service to others

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

6. Location Services

Certain features of Stamped require access to your device's location. By enabling location features, you acknowledge and consent to the collection of location data as described in our Privacy Policy. You can disable location access at any time through your device settings or within the Stamped app settings.

7. Third-Party Services

The Service may contain links to or integrations with third-party services (e.g., booking platforms, payment apps). These third parties have their own terms of service and privacy policies. We are not responsible for the practices of third-party services and encourage you to review their policies.

8. Content Moderation

We reserve the right, but are not obligated, to review, monitor, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise harmful to users or the Service. We will make reasonable efforts to notify you if we remove your content, unless doing so would violate the law or compromise an investigation.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through Settings → Account → Delete Account in the app. Upon deletion, your personal data will be purged within 30 days, subject to legal hold requirements. Some aggregated, anonymized data may be retained.

9.2 Termination by Stamped

We reserve the right to suspend or terminate your account at any time, with or without notice, for any of the following reasons:

• Violation of these Terms or our Community Guidelines
• Fraudulent, abusive, or illegal activity
• Conduct harmful to other users or to Stamped
• Extended inactivity (we will provide 30 days' notice before terminating inactive accounts)
• Legal requirements or court orders

Upon termination, your right to use the Service immediately ceases. We may retain data as required by law.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• Any information or content on the Service is accurate, complete, or reliable
• User-generated ratings and reviews are genuine or represent the actual quality of any place or experience
• The Service will meet your specific requirements

Travel involves inherent risks. We are not responsible for decisions you make based on content available on Stamped. Always exercise independent judgment when traveling.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STAMPED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Stamped and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at hello@stamped.app and attempt to resolve the dispute informally. We will make reasonable efforts to resolve the dispute within 30 days.

13.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if they qualify. This arbitration agreement covers all disputes related to these Terms or the Service.

13.3 Class Action Waiver

YOU AND STAMPED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. To the extent court proceedings are permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida.

15. General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Stamped regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
• Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
• Language: These Terms are written in English. Any translated versions are provided for convenience only; the English version controls.
